Workers’ Compensation laws: just the basics
In California, workers' compensation is a series of laws that provide workers' compensation benefits to those persons injured due to working conditions, including heavy lifting, defective machinery and equipment, dangerous premises, repetitive stress injuries, etc. Workers’ compensation is also available for illnesses that occur on the job due to hazardous chemicals, asbestos exposure, or other environmental contaminants.

With some exceptions, workers' compensation is a no-fault system of laws. If you were injured on the job, it generally does not matter who is at fault, if anyone, for the accident. Your employer’s insurance policy pays the claim.
While workers' compensation laws are supposed to be simple and expeditious, the opposite is the norm. The system can be extremely challenging to injured workers trying to recover from job injuries. The employer’s compensation insurance company has adjusters, investigators, doctors, and lawyers ready to lower the value of your claim.
Sometimes, a third party causes the injuries involved in a workers' compensation case. In that event, a civil lawsuit can be filed in Superior Court to achieve full compensation for the injured worker, as opposed to being limited to workers' compensation benefits. That’s why early retention of an expert legal team is so critical to the success of your case.
